Republican Senator says chances very good for limited "fiscal cliff" deal

WASHINGTON (Reuters) - Republican Senator Lindsey Graham said on Sunday that chances for a limited "fiscal cliff" deal in the next 48 hours were "exceedingly good," as talks to avoid tax increases and spending cuts on New Year's Day went down to the wire.

"I think people don't want to go over the cliff if we can avoid it," Graham, a leading conservative, said on Fox News Sunday.

He predicted that Republicans in Congress were going to accept some form of tax increases for wealthier Americans and this would hand a victory to President Barack Obama, although a leading Democrat warned of a big gap in talks between the parties.

Obama was "going to get tax-rate increases" on upper income Americans in the talks as he wants, Graham said.

The leading Senators from both parties are working on a stopgap fiscal cliff deal to avoid taxes increasing for almost all Americans on New Year's Day. They would probably leave the details of some other thorny fiscal issues, like government spending cuts, until January.

Graham urged Republicans to make a stand later when the time comes for Congress to decide on raising the debt ceiling.

"This deal won't affect the debt situation, it will be a political victory for the president and I hope we'll have the courage of our convictions when it comes time to raise the debt ceiling to fight for what we believe as Republicans, but hats off to the president, he won," Graham said.

Lawmakers are seeking a last-minute deal that would set aside $600 billion in tax increases and across-the-board government spending cuts that are set to start within days. If Congress does not act, the measures would likely push the United States into a recession.

Senator Richard Durbin, a member of the Democratic leadership, told the "Face the Nation" show on CBS that there was still a "chasm" between the two parties in fiscal cliff negotiations, but anything was possible when Congress faced a deadline.

Graham said that if the Senate was unable to come up with the votes, it would be more difficult for any deal to get through the House of Representatives.

"And I want to vote for it, even though I won't like it ... because the country has got a lot at stake here," he said.

As we welcome the New Year, I'd like to take a moment to thank you for following my stories in this section since I began two years ago. As a reward for keeping me company, I would like to share a few of the lessons I've learned from writing about people like you.

First, health is our natural state of being, and it includes mind, body, and spirit. Most of the people I've interviewed who enjoy perfect health, even during their late years, appear to be balanced in these three areas.

They don't just eat well and exercise, they are aware of their emotions, their level of stress and they have found a spiritual guide within themselves that affects how they see the world. There have been some exceptions, but the healthiest and happiest people I've interviewed take time to pray, meditate and enjoy nature. This affects their mood and the way they relate with others.

So as you seek to become healthier this year, take time to dwell within to find that spiritual center in which ever way you choose.

Science agrees that many of our diseases are?psychosomatic, influenced in some way by our emotions, our level of stress, previous traumas and experiences. Unsolved emotional problems continue to affect our decisions until we face them.

Take time in your day to address these areas and re-affirm your self worth.

Body and mind are equally affected by what we feed them. Be mindful of what you give your mind to eat. Just as much as you should pay attention to what you eat. What you give your mind can affect your body as much as what you give your body can affect the mind.?

Eating fruits and vegetables and exercising, nourishes your body. Exposing yourself to inspiring information and invigorating ideas will influence the way you think throughout the day, which will impact your emotions and in turn your words and actions.

Do what you enjoy everyday. Chances are you'll live longer or happier. And happiness is healthy in its own right.?

Exclusive: Huawei partner offered embargoed HP gear to Iran

(Reuters) - A major Iranian partner of Huawei Technologies offered to sell at least 1.3 million euros worth of embargoed Hewlett-Packard computer equipment to Iran's largest mobile-phone operator in late 2010, documents show.

China's Huawei, the world's second largest telecommunications equipment maker, says neither it nor its partner, a private company registered in Hong Kong, ultimately provided the HP products to the telecom, Mobile Telecommunication Co of Iran, known as MCI. Nevertheless, the incident provides new evidence of how Chinese companies have been willing to help Iran evade trade sanctions.

The proposed deal also raises new questions about Shenzhen-based Huawei, which recently was criticized by the U.S. House Intelligence Committee for failing to "provide evidence to support its claims that it complies with all international sanctions or U.S. export laws."

At least 13 pages of the proposal to MCI, which involved expanding its subscriber billing system, were marked "Huawei confidential" and carried the company's logo, according to documents seen by Reuters. In a statement to Reuters, Huawei called it a "bidding document" and said one of its "major local partners," Skycom Tech Co Ltd, had submitted it to MCI.

The statement went on to say, "Huawei's business in Iran is in full compliance with all applicable laws and regulations including those of the U.N., U.S. and E.U. This commitment has been carried out and followed strictly by our company. Further, we also require our partners to follow the same commitment and strictly abide by the relevant laws and regulations."

In October, Reuters reported that another Iranian partner of Huawei last year tried to sell embargoed American antenna equipment to Iran's second largest mobile operator, MTN Irancell, in a deal the buyer ultimately rejected. The U.S. antenna manufacturer, CommScope Inc, has an agreement with Huawei in which the Chinese firm can use its products in Huawei systems, according to a CommScope spokesman. He added that his company strives to comply fully with all U.S. laws and sanctions.

Huawei has a similar partnership with HP. In a statement, the Palo Alto, Calif., company said, "HP has an extensive control system in place to ensure our partners and resellers comply with all legal and regulatory requirements involving system security, global trade and customer privacy and the company's relationship with Huawei is no different."

The statement added, "HP's distribution contract terms prohibit the sale of HP products into Iran and require compliance with U.S. and other applicable export laws."

Washington has banned the export of computer equipment to Iran for years. The sanctions are designed to deter Iran from developing nuclear weapons; Iran says its nuclear program is aimed purely at producing domestic energy.

CLOSE LINKS

Huawei and its Iranian partner, Skycom, appear to have very close ties.

An Iranian job recruitment site called Irantalent.com describes Skycom as "a leading telecom solution provider" and goes on to list details that are identical to the way Huawei describes itself on its U.S. website: employee-owned, selling "solutions" used by "45 of the world's top 50 telecom operators" and serving "one-third of the world's population."

On LinkedIn.com, several telecom workers list having worked at "Huawei-skycom" on their resumes. A former Skycom employee said the two companies shared the same headquarters in China. And an Iranian telecom manager who has visited Skycom's office in Tehran said, "Everybody carries Huawei badges."

A Hong Kong accountant whose firm is listed in Skycom registration records as its corporate secretary said Friday he would check with the company to see if anyone would answer questions. Reuters did not hear back.

The proposal to MCI, dated October 2010, would have doubled the capacity of MCI's billing system for prepaid customers. The proposal noted that MCI was "growing fast" and that its current system, provided by Huawei, had "exceeded the system capacity" to handle 20 million prepaid subscribers.

"In order to keep serving (MCI) with high quality, we provide this expansion proposal to support 40M subscribers," the proposal states on a page marked "HUAWEI Confidential."

The proposal makes clear that HP computer servers were an integral part of the "Hardware Installation Design" of the expansion project. Tables listing equipment for MCI facilities at a new site in Tehran and in the city of Shiraz repeatedly reference HP servers under the heading, "Minicomputer Model."

The documents seen by Reuters also include a portion of an equipment price list that carries Huawei's logo and are stamped "SKYCOM IRAN OFFICE." The pages list prices for HP servers, disk arrays and switches, including those that already are "existing" and others that need to be added. The total proposed project price came to 19.9 million euros, including a "one time special discount."

The proposed new HP equipment, which totaled 1.3 million euros, included one server, 20 disk arrays, 22 switches and software. The existing HP equipment included 22 servers, 8 disk arrays and 13 switches, with accompanying prices.

Asked who had provided the existing HP equipment to MCI, Vic Guyang, a Huawei spokesman, said it wasn't Huawei. "We would like to add that the existing hardware equipment belongs to the customer. Huawei does not have information on, or the authority to check the source of the customer's equipment."

Officials with MCI did not respond to requests for comment.

In a series of stories this year, Reuters has documented how China has become a backdoor for Iran to obtain embargoed U.S. computer equipment. In March and April, Reuters reported that China's ZTE Corp, a Huawei competitor, had sold or agreed to sell millions of dollars worth of U.S. computer gear, including HP equipment, to Telecommunication Co of Iran, the country's largest telecommunications firm, and a unit of the consortium that controls TCI.

The articles sparked investigations by the U.S. Commerce Department, the Justice Department and some of the U.S. tech companies. ZTE says it is cooperating with the federal probes.

TCI is the parent company of MCI.

Google removed more than 50 million links in 2012 search crackdown over piracy claims

Google, the Internet search leader, removed more than 50 million links from search results this year for allegedly infringing the intellectual property of copyright holders.

According to an analysis of Google's weekly "transparency reports" performed by TorrentFreak editor ErnestoVan Der Sar, 51.5 million links to web pages allegedly infringing on copyrighted material were removed from search results in 2012.

"Nearly all of these web pages are no longer showing up in Google's search results," Van Der Sar reported.

Google, like any other website on the Internet, is obliged by federal law -- namely, the Digital Millennium Copyright Act -- to take down content when it receives a DCMA request from a copyright holder.

Van Der Sar noted that DCMA takedown activity has been increasing throughout the year, hitting a high point last week when Google received 3.5 million requests.

Google

Much of that takedown activity is being fueled by automated systems used by large copyright holders. Those systems can be wildly inaccurate, which can lead to lawsuits.

For example, an online storage service called Hotfile sued Warner Bros. Entertainment after that company's automated system flooded Hotfile with thousands of DCMA takedown requests for material Warner had no rights to.

Under the DMCA, any person making bad takedown requests can be penalised with monetary damages. Warner's defence in the Hotfile case is a person didn't make the bogus requests. A computer did.

Media companies, like Warner, are among the most prolific requesters of takedowns.

The biggest requester in 2012, Van Der Sar points out, was the Recording Industry Association of America, which asked Google to remove more than 7.8 million links from its search results.

The website most frequently targeted by rights holders was FilesTube, according to the TorrentFreak editor. More than 2.2 million links at that site allegedly infringed on copyrights, he noted.

"While this is certainly a significant number, it?s less than 1 percent of all FilesTube pages indexed by Google," he wrote.

Copyright holders aren't the only entities pressuring Google to remove links from search results.Governments do so, too. More than half those requests are made for concerns over defamation or privacy and security.

However, governments are interested in more than just taking down links from the Internet. They're also interested in obtaining information from Google that it has about its users. That trend, too, increased over 2012.

Last-minute fiscal cliff talks in Senate

WASHINGTON (AP) ? Senate leaders groped for a last-minute compromise Saturday to avoid middle-class tax increases and possibly prevent deep spending cuts at the dawn of the new year as President Barack Obama warned that failure could mean a "self-inflicted wound to the economy."

Obama chastised lawmakers in his weekly radio and Internet address for waiting until the last minute to try and avoid a "fiscal cliff," yet said there was still time for an agreement. "We cannot let Washington politics get in the way of America's progress," he said as the hurry-up negotiations unfolded.

For all the recent expressions of urgency, bargaining took place by phone, email and paper in a Capitol nearly empty except for tourists. Alone among top lawmakers, Senate Republican leader Mitch McConnell spent the day in his office.

In the Republicans' weekly address, Sen. Roy Blunt of Missouri cited a readiness to compromise. "Divided government is a good time to solve hard problems ? and in the next few days, leaders in Washington have an important responsibility to work together and do just that," he said.

Even so, there was no guarantee of success, and a dispute over the federal tax on large estates emerged as yet another key sticking point alongside personal income tax rates.

In a blunt challenge to Republicans, Obama said that barring a bipartisan agreement, he expected both houses to vote on his own proposal to block tax increases on all but the wealthy and simultaneously preserve expiring unemployment benefits.

Political calculations mattered as much as deep-seated differences over the issues, as divided government struggled with its first big challenge since the November elections.

Speaker John Boehner remained at arms-length, juggling a desire to avoid the fiscal cliff with his goal of winning another term as speaker when a new Congress convenes next Thursday. Any compromise legislation is certain to include higher tax rates on the wealthy, and the House GOP rank and file rejected the idea when he presented it to them as part of a final attempt to strike a more sweeping agreement with Obama.

Lawmakers have until the new Congress convenes to pass any compromise, and even the calendar mattered. Democrats said they had been told House Republicans might reject a deal until after Jan. 1, to avoid a vote to raise taxes before they had technically gone up and then vote to cut taxes after they had risen.

Nor was any taxpayer likely to feel any adverse impact if legislation is signed and passed into law in the first two or three days of 2013 instead of the final hours of 2012.

Gone was the talk of a grand bargain of spending cuts and additional tax revenue in which the two parties would agree to slash deficits by trillions of dollars over a decade.

Now negotiators had a more cramped goal of preventing additional damage to the economy in the form of higher taxes across the board ? with some families facing increases measured in the thousands of dollars ? as well as cuts aimed at the Pentagon and hundreds of domestic programs.

Republicans said they were willing to bow to Obama's call for higher taxes on the wealthy as part of a deal to prevent them from rising on those less well-off.

Democrats said Obama was sticking to his campaign call for tax increases above $250,000 in annual income, even though he said in recent negotiations he said he could accept $400,000. There was no evidence of agreement even at the higher level.

There were indications from Republicans that estate taxes might hold more significance for them than the possibility of higher rates on income.

One senior Republican, Sen. Jon Kyl of Arizona, said late Friday he was "totally dead set" against Obama's estate tax proposal, and as if to reinforce the point, Blunt mentioned the issue before any other in his broadcast remarks. "Small businesses and farm families don't know how to deal with the unfair death tax_a tax that the president and congressional leaders have threatened to expand to include even more family farms and even more small businesses," he said.

Several officials said Republicans want to leave the tax at 35 percent after exempting the first $5 million in estate value. Officials said the White House wants a 45 percent tax after a $3.5 million exemption. Without any action by Congress, it would climb to a 55 percent tax after a $1 million exemption on Jan. 1.

Democrats stressed their unwillingness to make concessions on both income taxes and the estate tax, and said they hoped Republicans would choose which mattered more to them.

Officials said any compromise was likely to ease the impact of the alternative minimum tax, originally designed to make sure that millionaires did not escape taxation. If left unchanged, it could hit an estimated 28 million households for the first time in 2013, with an average increase of more than $3,000.

Taxes on dividends and capital gains are also involved in the talks, as well as a series of breaks for businesses and others due to expire at the first of the year.

Obama and congressional Democrats are insisting on an extension of long-term unemployment benefits that are expiring for about 2 million jobless individuals.

Leaders in both parties also hope to prevent a 27 percent fee cut from taking effect on Jan. 1 for doctors who treat Medicare patients.

There was also discussion of a short-term extension of expiring farm programs, in part to prevent a spike in milk prices at the first of the year. It wasn't clear if that was a parallel effort to the cliff talks or had become wrapped into them.

Across-the-board spending cuts that comprise part of the cliff were a different matter.

Republicans say Boehner will insist that they will begin to take effect unless negotiators agreed to offset them with specified savings elsewhere.

That would set the stage for the next round of brinkmanship ? a struggle over Republican calls for savings from Medicare, Medicaid and other federal benefit programs.

The Treasury's ability to borrow is expected to expire in late winter or early spring, and without an increase in the $16.4 trillion limit, the government would face its first-ever default. Republicans have said they will use administration requests for an extension as leverage to win cuts in spending.

Ironically, it was just such a maneuver more than a year ago that set the stage for the current crisis talks over the fiscal cliff.

Flickr is the most popular photo-specific web service around (with over 26 million unique visitors per month, according to recent comScore numbers) and it earned our Editors' Choice as the best. But its mobile app has long been held up as a missed opportunity because of the many features of the main service it lacked. A recent major update changes all this?it's now a fantastic photo app?and adds a strong play in the social networking ecosystem, with Facebook, Twitter, and Tumblr integration. But maybe most significant new features are its Instagram-like photo enhancements, which, coming on the heels of Instagram's recent lessening of Twitter integration, could be a big new venue for Flickr.?

Setup/Signup
In the iTunes App Store, the same new Flickr app states support for both iPhone and iPad, though it only appears in the iPhone section. Users of the new iPhone 5 will be happy to note that the new app takes advantage of their phone's longer display. Unfortunately, on the iPad, the app is formatted with the small iPhone-size image; you can hit the 2x button to fill most of the screen. Of course, you could just go to the full Web version in Safari on the iPad. If you don't have a Flickr account, you can sign in with your Facebook or Google account, and of course, a Yahoo Mail login works

Interface and Features
In place of the old app's three simple tabs for Recent, You, and Contacts, you now get five buttons across the bottom for contacts/groups, Interesting/Nearby, your own Photo Stream and Activity, and More, which offers searching among other functions. This is one interface design aspect that some may prefer the old app for?there the search box was prominently at the top of the home page.

The really great thing about the new interface is its use of the swipe gestures. I can swipe sideways through any of my contacts' photo streams or up and down to switch among contacts. In the Interesting/Nearby mode, accessible from the globe button, I can swipe down through all the cream of the photos culled from nearly 2 million daily uploads. And all this swiping and switching among button modes is superfast; Yahoo has clearly put efforts into the performance of the app.

Instead of showing a grid of small square boxes when you're viewing a photo stream or set, the new app uses the much more appealing "justified" layout familiar from the new Flickr Web design. This layout offers a much better view of the photos, and you don't get it with Picasa's mobile experience (Picasa doesn't have an iOS app) or in apps from Photobucket, SlickPic, or even Instagram.

The individual photo view is also improved. Tapping on the image opens it in full screen, but not you can zoom in by spreading fingers on it?up to its full resolution?and pinch to zoom out. The old app only let you fit the image to the phone's screen?no pinch zooming. You can still comment on, favorite, and share a photo from its page, and now, clicking the "i" brings up the photo's map, tags, groups it's included in, and EXIF info such as shutter speed, ISO, focal length, and F-stop. To Favorite a photo, you double-tap on it; I actually prefer heart button, which seems less likely to result in unintentional favoriting.

One thing you can't do is save a photo from a Web album to your phone, something available in the previous version. This app is more about going the other way?taking pictures with your iPhone and uploading them to the service and sharing them on social sites. It now even offers batch uploads, where you select multiple photos for uploading at once. But hopefully the Flickr dev team will restore the ability to download photo stream images in a future update.

I've been sleeping on the floor since about 8-9th grade. I like it for some reason. It's comfy. I used to sleep with a thick comforter under the floor, but now I just sleep on top of a sorta thin comforter. I don't know, I mainly like it because if I need more space or whatever, I can just move all my blankets to the side and have more space. People say I'll mess my back up with it, but it seems the opposite for me. I don't know, for some reason I just feel better sleeping on the floor. For a few years I slept on a mattress on the floor (due to DCF calling my mother terrible for allowing me to move my mattress and bed out of my room,) and for one or so, futons, but I keep going back to just the floor and a blanket, as it's just most comfortable.

So anyone else like sleeping on the floor?

Obama Still Hopeful in Final Days Before 'Cliff'

Three days remain for Congress to pass a federal budget agreement that would avoid the so-called "fiscal cliff" and today President Obama said he believes the House and Senate leadership can squeak out a deal in time.

In his weekly address, released this morning, the president said allowing the package of perilous tax increases and budget cuts set to take effect in the New Year "would be the wrong thing to do for our economy."

"Congress can prevent it from happening if they act now," he said. "Leaders in Congress are working on a way to prevent this tax hike on the middle class, and I believe we may be able to reach an agreement that can pass both houses in time."

The president was referring to Senate Majority Leader Harry Reid, D-Nev., and Minority Leader Mitch McConnell, R-Ky., who were attempting to quickly fashion a deal that can pass both chambers of Congress. Although not mentioned specifically in the video, the two leaders and their House counterparts, Speaker John Boehner, R-Ohio, and Rep. Nancy Pelosi, D-Calif., met with the president and his staff at the White House Friday that left both parties' leadership cautiously optimistic in public statements following the meeting.

Largely repeating remarks he made following the meeting, the president noted that should the last-minute wrangling fail he has asked Reid to deliver a basic proposal to the Senate floor for a simple up-or-down vote.

"We believe such a proposal could pass both houses with bipartisan majorities -as long as these leaders allow it to come to a vote. If they still want to vote no and let this tax hike hit the middle class, that's their prerogative - but they should let everyone vote. That's the way this is supposed to work," he said. "We just can't afford a politically self-inflicted wound to our economy."

Reid's backup legislation would reflect the Democrats' side in this quagmire, demanding a tax boost for household incomes greater than $250,000 and an extension of unemployment benefits for roughly 2 million Americans that is set to expire without their reauthorization.

Fiscal Cliff: By The Numbers

"You meet your deadlines and your responsibilities every day," Obama said. "The folks you sent here to serve should do the same."

The president's statement came a day before what could be a critical turning point in the "cliff" ordeal. On Sunday, the House of Representatives returns from holiday recess, the same day McConnell and Reid could offer up a hypothetical deal for a vote. Meanwhile, NBC's "Meet the Press" will air a televised interview with Obama that morning.

Next Media Animation, the Taiwanese animation company that produces short cartoons recapping the news of the day, has its best muse in sports, where the lines between good and evil lend themselves to pictures of angry video game characters, and events are just cartoonish enough to spark the overactive NMA imagination. It's a vision of what sportswriting once was: loose with the facts, endlessly biased, and happy to caricature villians and add fantastical unlikelihoods to its summaries. As the name suggests, you get to play a U.S.?Colonial Marine on a mission to investigate the U.S.S. And?we're hoping that, at some point in the game, we'll also get to utter the phrase, "Game over man, game over!"

"Rayman Legends," Wii U?-?Feb. 26
The bright, colorful, zany platforming game "Rayman Origins" was one of my very?favorite games of 2011. And "Rayman Legends"???a direct sequel to that game???looks like it will offer even more?music-filled, action-packed, wacky fun???but with a new twist.?That is, "Rayman Legends"???originally scheduled to arrive in November???will launch exclusively for Nintendo's new Wii U game machine in February instead. And since it's a Wii U exclusive, that?means it will be putting the machine's unique tablet-style GamePad?controller to use.

I gave?"Legends" a try at the Penny Arcade Expo earlier this year and loved the way?one player could use?the GamePad controller ??and?its touchscreen ??to assist up to four other players using standard?Wii Remote controllers. You can use the GamePad to do?things like grab and pull creatures out of the ground, open secret paths and knock enemies out of the way. I dare say "Rayman Legends" is a very good reason to pick up a Wii U if you haven't already.

"Tomb Raider,"?Xbox 360, PlayStation 3, PC?-?March 5
The forthcoming "Tomb Raider" game is another title?that found itself?delayed from 2012 to 2013. But hopefully that extra time will mean extra polish for?this reboot of one of the most famous series?in video?game history.?

The action-adventure/platforming?game is set to?re-imagine leading lady Lara Croft's early, formative years. And while it has already inspired its fair share of controversy?due to an alleged sexual assault scene, we can't wait to see the new places the?developers take this storied franchise. From what we've seen so far, Croft has been given a darker, grittier backstory (a la the?character reboot we've seen in?the new Batman/Dark Knight?films). It's a backstory that makes her more human and less of a (top-heavy)?caricature. And to that we say: It's about time.

"Bioshock Infinite," PlayStation 3, Xbox 360, PC?-?March 26
Earlier this year, the team at Irrational Games told?us we'd have to wait until next year?to get our hands on "BioShock Infinite" because they wanted more time to make it "even more extraordinary."?Needless to say, after all this waiting, our expectation for this game???the third in the critically acclaimed?BioShock franchise???are very high.

And, indeed, "Infinite"?will take us back in time and?high up into the sky, as we play?agent Booker DeWitt, a man sent on a mission?to the airborne city of Columbia. His mission: to find a young woman named Elizabeth (recently?modeled by Russian gamer/costumer?Anna Moleva). This first-person shooter promises to?drop players into a intrigue-and-adventure-filled?alternate vision?of America during the Age of Steam, while bestowing upon?us?some unique powers.

The waiting isn't over yet, but in the meantime you can check out the new?video above, which offers a preview of the first few minutes of "Bioshock Infinite."

"Injustice: Gods Among Us," Xbox 360, PlayStation 3, Wii U - April
There is an age-old question asked by geeks of all ages: Who would win in a fight ... ?Batman or Superman? Flash or the Green Lantern? Catwoman or Wonder Woman? The forthcoming fighting game "Injustice: Gods Among Us" will, at last, provide us with the answers we seek.

The game drops many of your favorite heroes and villains from the DC Comics universe into "a world where the lines between good and evil are blurred." And it's here that the developers at NetherRealm promise "Injustice" will give us "heroes and villains engaging in epic battles on a massive scale." A look at the trailer above shows they aren't kidding. When superheroes collide, mere mortals better run and hide.

"The Last of Us," PlayStation 3?-?May 7
Brought to us by the developers behind the critically acclaimed?Uncharted games, "The Last of Us" not only promises to?blend survival and action gaming?elements in unique ways, but to take us on a story-driven journey with deep, well-crafted characters.

The game takes place 20 years after a plague decimated the population, leaving civilization in ruins and the survivors?not only fighting off?infected humans but fighting with?their own fellow survivors as well. It's in this setting that we meet the grizzled survivor?Joel and the?14 year-old girl, Ellie, that he's charged with protecting. "The Last of Us" is the kind of game aimed at?grown-up players looking for thoughtfully?crafted,?grown-up gaming. Fans of "The Walking Dead" should definitely be?lining up for this one.

"Grand Theft Auto V,"?PlayStation 3, Xbox 360?-?Spring 2013
At long last, Grand Theft Auto?is hitting the road again. The?GTA games have pioneered open-world gaming, giving players the freedom to roam immense digital landscapes filled with crime,?adventure and?some very colorful characters. And Rockstar says that "GTAV" ??which takes place in and around?the fictional Southern California city of Los Santos???will be its?biggest game?yet.

"Grand Theft Auto V"?will allow players to switch between three friends/partners in crime and will?center around performing heists.?We'll get to play?Michael, a wealthy ex-gangster; Trevor, a wise-cracking crazy man with a short fuse; and?Franklin, a professional repo man. Sounds like a recipe for?trouble?... and lots of crime-filled?fun. Meanwhile,?"GTAV" developer Rockstar Games?recently revealed that the game will head underwater as well. Eastern port operators and longshoremen agreed Friday on a royalties package, extending contract negotiations 30 days. The strike threat at ports signals that labor is ready to fight for its life, experts say.

Port operators and Eastern longshoremen agreed Friday to avoid a potentially crippling strike set for Sunday at 14 major US ports, at least for now. Negotiators refused to release details of the deal, but labor experts suggest the daring strike threat by dockworkers is indicative of a broader gambit by a besieged labor movement to claw back some power amid a strengthening US economy.

The agreement over so-called ?container royalties? worth up to $15,000 a year for an average longshoreman does not fully resolve the dispute, but is part of a 30-day contract negotiation extension agreed upon by the International Longshoremen?s Association and the US Maritime Alliance, which represents shipping companies and ports.

?The container royalty payment issue has been agreed upon in principle by the parties, subject to achieving an overall collective bargaining agreement,? said George Cohen, director of the Federal Mediation and Conciliation Service.

While federal mediators refused to disclose the agreement and said ?significant issues remain in contention,? Mr. Cohen said what he can report ?is that the agreement on this important subject represents a major positive step toward achieving an overall ? agreement.?

With Washington frantically trying to stave off a national ?fiscal cliff? of tax increases and automatic budget cuts, the already wobbling US economy likely would have teetered further if the 14,500 longshoremen had walked off docks from New York to Houston on Sunday. The workers handle 40 percent of US container traffic ? about 100 million tons a year ? and a strike could have cost $1 billion a day by blocking what is, in effect, the lifeblood of the US marketplace.

The situation had become serious enough for state leaders, including Florida Gov. Rick Scott, to call on President Obama to invoke the Taft-Hartley Act, a federal labor law used by President George W. Bush to end a 10-day, 29-port lockout on the West Coast in 2002.

The gritty longshoremen, meanwhile, are uniquely situated to push their agenda, even at the risk of losing public and political support, labor experts say. While relatively small, the longshoremen?s union historically has been aggressive in protecting its workers? benefits, and its members? central role to the US economy makes the union a particularly tough negotiator.

The strike reprieve was in part achieved with the help of federal negotiators dispatched by Mr. Obama, who owes much of his political success to unions but who has been wary of pursuing pro-union legislation that could negatively impact the soft economy.

Ouya developer kits are shipping, $99 Android game console ...

The makers of the Ouya video game console have started shipping developer kits to folks who paid $699 or more during the team?s successful Kickstarter campaign. The company plans to start shipping Ouya units to customers early in 2013, with the video game console selling for about $99 plus shipping.

SlashGear reports the first units should begin arriving this week.

The Ouya game console is a small box with an NVIDIA Tegra 3 quad-core processor, 1GB of RAM, 8GB of storage, WiFi, Bluetooth, a USB 2.0 ports, Ethernet, and HDMI ports.

It runs Google Android software, but it?s not a phone or a tablet. Instead the Ouya console is designed to be plugged into your television so you can play games on the big screen. It also includes a wireless game controller, a game store, and more.

The developer consoles come with two controllers ? but their main appeal is that they?re shipping a few months ahead of the final units, which should give game developers (or serious enthusiasts) a chance to try out the device before it?s available to the general public, and adapt games to run on the platform.

While there?s no shortage of video game consoles for the living room, the developers of the Ouya project want to lower the barriers to entry for independent game developers. Basically, if you can create a game that runs on Android, it can run on Ouya ? you don?t need to go through the hassle of signing with a game publisher, packaging the title on a disc and distributing it to game stores.

On the other hand, the Ouya is expected to ship to regular customers in early 2013 with hardware that was state of the art in early 2012. While you can still write some pretty nifty games for the Tegra 3 processor, Samsung and Qualcomm are already offering mobile processors with significantly more graphics power, and NVIDIA is expected to launch a Tegra 4 chip soon.

Will the Ouya feel dated by the time it finally arrives? Then again? with a $99 price tag, does it really matter?

The salesman at the golf course

Formerly the salesman or sales manager could be doing his business during an afternoon golf with other businessmen. This setting has been portrayed and idealized over many years.

The salesman:
- Could do his business with people he knew since long
- Had a Rolodex with business cards where he could rely upon
- Was more an account manager than a sales guy

His world was organized and nothing could really interfere in his sales or customer retention process.
Business, golf and pleasure all fitted well together.

Communication technologies

Communication technologies have changed the way people do business over years:
Fax
Fax introduced the speed of immediate delivery of documents ? no physical transport required.
Thus the salesman didn?t need to visit and collect the order anymore.
That meant less face to face communications, thus less information exchanged.

Email
Email brought the increase of speed in written communications ? both ways.
There were no more delays as with mailing letters and waiting for a physical reply.
The salesman could communicate more directly and have faster interactions.
This has increased his productivity, as he could respond more quickly and could work on more deals at one time.
Additionally there is an administrative benefit as the emails are kept automatically in a folder. Hence no administrative filing and easy retrieval.

Mobile phones
Mobile phones made the salesperson available everywhere.
Previously calling could only be done in the office or at home which limited the availability during the week of a salesman.
Using a mobile phone, the salesman can discuss with the potential customers or customers anywhere and anytime.
Instead of face to face communications requiring appointments, calls could be made whenever possible and appropriate.

The Internet
The Internet has bought several changes:
1) Information distribution
The internet made company, product and services information available to interested parties and to customers, without needing to ask the salesman
The salesman was no longer in the loop with interested parties and customers
This has led to the rise of the ?Unknown Buyer?.

2) Rolodex
The Internet allowed finding and / or retrieval of possible contacts within an organization or company.
At first this started with simple searches on Google using the domain name.
Then the specific organized websites like LinkedIn, Plaxo, Jigsaw, Zoominfo, Xing, Spoke, Viadeo, ?

The partly free availability of contact information:
- Decreased the power of the salesman with the Rolodex significantly.
- Changed cold calling forever.
This has increased the competition and will continue to increase competition as people within companies have become addressable.

3) Webinars
Instead of paying a visit, sales people could set-up webinars in order to give an on-line interactive sales presentation.
No travel required for a first meeting with the interested parties: hence fewer costs and less waste of time for travel.
Again the salesman could follow-up on more leads than before and quickly move on if the potential customer is not interested.

Still playing golf?

The Salesman can still spend his days on the golf course, while his invited business friends will be receiving phone calls or emails from competition on their smart phones whilst playing golf.
By the time the game is over, the competition could already have sent a quotation by email received on the smart phone.
